📶 በድሮውና በአዲሱ የፌዴራል መንግሥት የግንባታ የግዢ አፈፃፀም መመሪያ ላይ የተደረጉ ዋና ዋና ማሻሻያዎች በጥልቀት እንደሚከተለው አዘጋጅቼ አቀርብላቹዋለሁ። 1. በሪቴንሽን (Retention) ላይ የተደረገ ማሻሻያ በቀድሞው አሰራር ሪቴንሽን በተለምዶ 5% የሚታወቅ ሲሆን፣ በአዲሱ የግዢ አፈፃፀም ስር 7% ተደንግጓል። ይህም በክፍያ አፈፃፀም የተመለከተው Section 73 (Payment Procedure) ስር ተጠቅሷል። ከዚህ በተጨማሪ፣ ሪቴንሽን ክፍያ መለቀቅ (release) በ50%-50% ስርዓት ተደንግጓል፤ 50% በTemporary/Provisional Acceptance 50% ከ12 ወር Defect Liability Period በኋላ ይህ ከቀድሞ አሰራር የበለጠ ግልፅነትና የህግ መሠረት ያለው ማሻሻያ ነው። 2. በክፍያ አፈፃፀም (Payment Procedure) ላይ የተደረገ ማሻሻያ ቀድሞ የክፍያ ጊዜ ገደብ ግልፅ ያልነበረ ሲሆን፣ በአዲሱ ሥርዓት Section 73 መሠረት፦ IPC በ7 የስራ ቀናት ውስጥ መሰጠት አለበት ክፍያ በ30 ቀናት ውስጥ መፈፀም አለበት ይህ የtime-bound payment system በማስገባት የክፍያ መዘግየትን ለመቀነስ የተደረገ ትልቅ ማሻሻያ ነው። 3. በVariation እና Additional Works ላይ የተደረገ ማሻሻያ በቀድሞው ሥርዓት variation በብዙ ጊዜ ያለ ግልፅ ገደብ ሊፈጸም ይችል ነበር። አዲሱ ሥርዓት ግን Additional Works ከOriginal Contract Value 30% መብለጥ አይችልም ብሎ ገደብ አስቀምጧል። ይህ የvariation abuse ለመከላከል የተደረገ ትልቅ ማሻሻያ ነው። 4. በPrice Adjustment (Escalation) ላይ የተደረገ ማሻሻያ በአዲሱ አፈፃፀም Price Adjustment በformula-based system እንዲሰራ ተደርጓል። እንዲሁም Maximum 25% Contract Value Cap ተቀምጧል። ይህ uncontrolled escalation ለመቆጣጠር የተደረገ ዋና ማሻሻያ ነው። 5. በConsultant Liability ላይ የተደረገ ማሻሻያ በአዲሱ ሥርዓት BOQ/Design Error 15% በላይ ከሆነ liability trigger ይፈጠራል። ይህ በቀድሞ አሰራር በደካማ ሁኔታ የነበረውን consultant accountability ያጠናክራል። 6. በContract Administration ላይ የተደረገ ማሻሻያ Section 56–74 የውል አስተዳደርን በተደራጀ መልኩ ያቀርባል። ይህ የሚያካትተው: Performance Security Advance Payment Payment Settlement Liquidated Damages Contract Termination Dispute Resolution Contract Closure ይህ fragmented system ከነበረው ወደ integrated lifecycle system የተደረገ ማሻሻያ ነው። ✅ መደምደሚያ በአጠቃላይ ዋና ዋና ማሻሻያዎች: ➣ Retention 5% → 7% (Section 73) ➣ Payment deadline 7 ቀን IPC / 30 ቀን payment (Section 73) ➣ Variation cap 30% ➣ Escalation cap 25% ➣ Consultant liability trigger 15% ➣ Contract Administration (Section 56–74) ተጠናክሯል
